The big question is where is John Kerry and what will he do to contest the election. Is Kerry lining up his ducks to really contest this issue of Election fraud, or is he in hiding? Washington -- December 13, 2004 -- TomFlocco.com -- After listening to unofficial but stunning testimony concerning evidence of state-wide vote fraud during a House Judiciary Committee hearing on 2004 election irregularities in Ohio, ranking Democrat John Conyers (D-14-MI) was asked whether he would consider challenging the seating of Buckeye state electors on January 6 when Congress opens the presidential electoral college vote certifying the election of George W. Bush.

Conyers, a Michigan Democrat and senior committee member who convened the Ohio voting aberrations hearing held last Wednesday in the House Rayburn office building, replied, "We are now."

Many Democrats now consider John Kerry's premature concession to George Bush a costly mistake which constitutional scholars say could ultimately affect the rigor, intensity and thoroughness of state and federal judges adjudicating the ongoing Ohio election litigation--a series of unpublicized lawsuits which could augur potential criminal prosecutions.

Except for some post-election reporting by MSNBC Countdown cable TV host Keith Olbermann--who has ceased covering the story in recent days--there has been a curious mainstream television and radio news black-out regarding the state's explosive and expanding electoral conundrum since November 2.

Conyers had expressed concern to Olbermann that "evidence can be moved or changed if it's not kept properly until we can get the Government Accounting Office to investigate," referring specifically to Canton, Ohio's Diebold Corporation--a major flashpoint in the vote scandal, while further emphasizing the necessity for proper and immediate impounding of Ohio machines.

Stanford computer science professor David Dill also told Olbermann "I know there are a lot of different ways to hack the machines, and the auditing we ought to be doing to catch it is...not being done," adding "...those exit poll companies owe an explanation to the American people. And they owe us the release of the data, so that independent experts can check their claims.

The allegations in Ohio but also in Florida are significant because a change in the election results in either state would cause a new slate of Democrat electors to shift the final electoral college count in Kerry's favor; and there is still time for a full recount before Congress certifies the electoral results on January 6, 2005.

Kerry's recount cash

The allegations in Ohio but also in Florida are significant because a change in the election results in either state would cause a new slate of Democrat electors to shift the final electoral college count in Kerry's favor; and there is still time for a full recount before Congress certifies the electoral results on January 6, 2005.

According to pre-General Election filings and the Center for Public Integrity (11-1-2004), the Kerry Campaign has $51.6 million cash-on-hand--more than enough for recounts, legal battles, voting machine tabulator analysis and other investigations in Ohio in order to make a clear-cut case for vote fraud.

But the senator's failure to forcefully seek legal redress to investigate the allegations will make Conyers' position that much more problematic in front of the House and the Senate in January.

According to George Washington University constitutional law professor Jonathan Turley, "On December 7, the electors are certified under federal law and on December 13, the electors actually vote...but those votes are not opened by Congress until January 6. Now, if there are controversies such as some disclosure that a state actually went for Kerry, there is the ability of members of Congress to challenge."

Turley continued: "It requires a written objection from one House member and one senator. If that objection is recorded, then both Houses separate again and they vote by majority vote as to whether to accept the slate of electoral votes from the state in question."

Turley said "over 70% of Ohio's votes were done with punch cards. We know that when you challenge those, they tend to turn over. So there is still room for challenge in Ohio...but without the [major] candidate [the one who suffers the most irreparable harm], judges don't really work that hard."

A post-election Associated Press (AP) report provided evidence that Kerry did not intend to fully use his massive campaign war-chest, as an inner-circle campaign aide said the cash should have been spent in late July to build political organizations in Ohio and Florida--the key states where voting irregularities may have been employed to win enough electoral votes to tip the balance.

Other senior campaign aides told AP reporter Ron Fournier that Kerry wanted to save the money in the event of a recount, legal challenges or other unforeseen bills. Investigative analysis of electronic voting machines and central tabulators was not mentioned by the AP.

In Cleveland's Cayahoga County alone, 29 separate voting precincts show 93,000 more votes than registered voters

The testimony Conyers heard represented more disputed votes than Bush's 136,000 margin and the House Ranking Member promised to hold congressional hearings in Ohio to question the election's legitimacy and whether President Bush was entitled to the state's 20 electoral votes from 5.8 million ballots cast--the closest winning margin by a sitting president since Woodrow Wilson

Kerry also declined to forcefully promulgate state-wide evidence of vote fraud before the American people which would have magnified the importance of a full and thorough Buckeye recount while also forcing television coverage, thus convincing Ohio judges--but also Supreme Court Justices watching from the sidelines--that Kerry was dead serious about exposing voting machine technical secrecy and corporate privatization of the American election process.

Kerry's curious recalcitrance

The Democrat standard-bearer has also received much criticism from party faithful for allowing independent candidates to struggle to accumulate a few hundred thousand dollars in small contributions for state-wide recounts from many of the same voters who originally financed the Kerry-Edwards campaign.

With substantial evidence pointing to stolen Buckeye electoral votes, Kerry has failed to marshal his substantial election recount war-chest for the purpose of financing battleground state lawsuits, impounding electronic voting machines and county-wide central tabulators, employing computer experts for forensic analysis of computer hard-drives and software, hiring expert courtroom witnesses, researchers and investigators, and seeking the initiation of a criminal investigation for credible evidence of vote fraud and denial of equal protection under the law.

Voter turnout exceeds number of registered voters

In Cuyahoga County, home of Cleveland, Ohio's huge minority population, 30 precincts recorded over 100,000 more votes cast than the County's 251,946 registrations--equaling a 39% over-vote, an incredibly shocking statistic deserving a serious investigation for fraud by any fair-minded legislator. In a few of the precincts the over-vote was 100%, as one precinct with 558 registered voters cast nearly 9,000 ballots, according to Zogby.com.

The evidence of fraud is so obvious--so blatant, one would think that if Kerry and Democratic legislators refuse to press for a criminal investigation, they would at least divert some of the senator's enormous sock of leftover campaign cash toward a down payment to purchase their own electronic voting machine corporation.

They could start to compete with machines and software owned or controlled by Republican backers, Bush "Ranger" and "Pioneer" contributors--and incredibly, U.S. Senator Chuck Hagel.

Kerry lawyer asks for visual inspection of some Ohio ballots

COLUMBUS, Ohio -- Democrat John Kerry is asking county elections officials to allow his witnesses to visually inspect the 92,000 ballots cast in Ohio in which no vote for president was recorded, a Kerry lawyer said Sunday night.

The request is one of 11 items that Kerry is asking for as part of the recount that Ohio's 88 county boards of election will begin this week, according to a letter sent to the boards over the weekend.

"We're trying to increase the transparency of the election process," said Donald McTigue, the lawyer handling the recount for the Kerry campaign.

McTigue said the visual inspection is allowed under state law. The goal is to look for potential votes that were not registered by the tabulating equipment.

Other requests include the use of independent experts to check the programming and calibration of the election equipment, something McTigue said has never been allowed.

McTigue also asked that counties accept the help of a group called Votewatch to determine which precincts will be chosen for that part of the vote that will be counted by hand. McTigue said using the group will ensure that the ballots are selected using a valid random sampling method.

Startling new revelations about Ohio's presidential vote have been uncovered as Democratic members of the House Judiciary Committee join Rev. Jesse Jackson in Columbus, the state capital, on Monday, Dec. 13, to hold a rare field hearing into election malfeasance and manipulation in the 2004 vote. The Congressional delegation will include Rep. John Conyers (D-MI), Rep. Maxine Waters (D-CA), Rep. Stephanie Tubbs-Jones, and others.

On Sunday, John Kerry spoke with Rev. Jesse Jackson and urged him to take an more active role in investigating the irregularities and ensuring a fair and impartial recount. Kerry said there were three areas of inquiry that should be addressed: 92,000 ballots that recorded no vote for president; qualifying and counting provisional ballots; and supported an independent analysis of the software and set-up of the optical scan voting machines.

A Theologian Asks the Hard Questions About 9/11

David Ray Griffin is one of the most respected philosophers of religion in North America. He is the author or editor of more than 24 academic books, including works co-written with the deans of world religions, Huston Smith and Martin Marty. He has lectured around the world, including at UBC.

Griffin is one of those profiled in the prestigious volume, A Handbook of Christian Theologians. He's painstakingly probed countless philosophical challenges, from the question of why there is evil to the relationship between science and religion, for which he's won numerous awards.

So why did this soft-spoken professor from the high-ranking Methodist-rooted School of Theology at Claremont, Calif., feel it necessary to risk his hard-earned reputation as a religion scholar to write one of the most incredible -- in all senses of the word -- political books of 2004?

Because no one else in mainstream America seemed prepared to do it...

The result? Griffin's book, The New Pearl Harbor: Disturbing Questions About the Bush Administration and 9/11 (Interlink Publishing, $22.50) has already sold an astonishing 80,000 copies.

Griffin's unflinching analysis of the unanswered questions surrounding the Sept. 11, 2001, terrorist attacks on New York and Washington has made Amazon.com's bestseller list despite receiving virtually no reviews in North America's mainstream media. That's unlike in Britain, where he's had solid coverage, including a three-page spread in London's mass-circulation Daily Mail.

Personally, when people ask how a group of Muslim extremists could have pulled off the devastating suicide attacks against the U.S., in spite of the country's global intelligence network and massive defence arsenal, I tend to side with the German philosopher, Goethe, who once said: "Why look for conspiracy when stupidity can explain so much?"

But when Griffin, who's known for his careful approach to philosophical problems, poses a series of questions suggesting the administration of George W. Bush had been warned about the terrorist attacks and did nothing, it's enough to make you shudder. The implications would make the Watergate scandal look like a Sunday brunch.

In effect, The New Pearl Harbor fleshes out in 214 pages the question asked in the final moment of Michael Moore's Academy-award-winning documentary, Fahrenheit 911. That's when the filmmaker wonders aloud: What exactly was Bush thinking as he sat in front of a bunch of school children reading a book titled My Pet Goat, knowing two jetliners had been flown into the World Trade Center?

Griffin's book is titled The New Pearl Harbor for two reasons. One, because that's what Bush wrote in his diary on the evening of Sept. 11: "The Pearl Harbor of the 21st century took place today." But also because members of the Bush administration in 2000 helped author the document, Project for the New American Century, which opined it would be difficult to galvanize Americans to support military expansion in Afghanistan, Iraq and elsewhere unless a "new Pearl Harbor" occurred.

Here are a few of the questions Griffin looks into:

* Why did the Bush administration say it didn't anticipate the Sept. 11 attacks when the CIA and FBI had repeatedly told it al-Qaida was planning to hijack planes and fly them into U.S. targets, including the World Trade Center and the Pentagon?

* Why were standard procedures that could have prevented the tragedy not followed when the four hijacked planes went off course, including immediately sending up jet fighters to shoot down passenger planes that fail to obey orders?

* Why has there been no physical evidence a jet plane crashed into the Pentagon? Independent onlookers say they saw a missile fly into the building. Video evidence shot by a nearby gas station's security cameras was confiscated by government officials.

* Why did Bush, despite knowing about first one, then two, World Trade Center crashes, delay his response to them for up to 30 minutes and instead continue to read a children's book? Why was he not whisked away by his security agents, who are trained to believe he's a logical target of terrorists?

* Who made tens of millions of dollars by betting on the stock market in the weeks before Sept. 11 that shares in the two airlines that owned the hijacked planes were about to plummet?

The Bush administration has brushed off all such questions. For his part, Griffin doesn't argue the Bush administration was actually complicit in the attacks. Some of the professor's fans have regretted his cautiousness, because he won't compile a grand theory about why the attacks may have been allowed to happen. He consistently avoids inflammatory rhetoric.

After more than 3 1/2 years of foot-dragging, excuses, and violations of federal regulations, MIT announced last week that it could not investigate credible evidence of possible scientific fraud in fundamental National Missile Defense research being done at MIT's Lincoln Laboratory. The reason outgoing president Charles M. Vest gave is that the Pentagon had classified everything about the investigation.

The allegations of fraud involve the critically important Integrated Flight Test 1A, or IFT-1A, in June 1997. Its purpose was to determine if the currently deployed National Missile Defense could tell the difference between warheads flying through space and simple balloons designed to look like warheads. If the IFT-1A experiment could not demonstrate that the weapon could perform this task, the weapon could never have a realistic chance of working in combat.

In May 2000 I sent evidence to the White House that, despite the claims of unqualified success by the Pentagon, the IFT-1A had in fact been a total failure.
